Terms of Service
Yuma Crane Connect™ Last updated: November 3, 2026
PLEASE READ THESE TERMS CAREFULLY. SECTION 18 REQUIRES YOU TO RESOLVE DISPUTES BY BINDING INDIVIDUAL ARBITRATION, AND WAIVES YOUR RIGHT TO A JURY TRIAL AND TO TAKE PART IN A CLASS ACTION. SECTIONS 10 AND 11 LIMIT OUR LIABILITY. ALL SALES ARE FINAL (SECTION 6).
1. Who We Are and Agreement to These Terms
1.1 These Terms of Service ("Terms") are a binding legal agreement between you and Continuing Education And Training, LLC, an Arizona limited liability company doing business as Yuma Crane Connect™ ("Company," "we," "us," or "our").
1.2 These Terms cover every website, app, platform, listing, directory, marketplace, course, digital product, message, software, AI feature, and other service we offer under Yuma Crane Connect™, including the Yuma Crane Connect™ crane rental request service and the Yuma Crane Connect™ crane lead referral subscription for crane operators (together, the "Services").
1.3 Electronic acceptance is your signature. By checking the box marked "I agree to the Terms" (or a similar box), clicking a button that refers to these Terms, creating an account, making a purchase, or using the Services, you agree to these Terms. You agree that this electronic acceptance is your legal signature under the federal E-SIGN Act and the Arizona Electronic Transactions Act and has the same effect as a handwritten signature. We may keep a record of your acceptance, including date, time, IP address, and the version of the Terms you accepted.
1.4 If you do not agree, do not use the Services.
1.5 If you accept on behalf of a business or other organization, you promise you have authority to bind it, and "you" includes that organization.
1.6 You must be at least 18 years old (or the age of majority where you live) to use the Services.
Contact address: Continuing Education And Training, LLC, 500 Westover Drive, Suite 17707, Sanford, NC 27330. Email: hello@yumacranerental.com.
2. Changes to These Terms
2.1 We may change these Terms at any time by posting the updated Terms on the Services and updating the "Last updated" date. Changes take effect when posted unless we say otherwise.
2.2 If you keep using the Services after changes are posted, you accept the changes. If you do not agree, you must stop using the Services.
2.3 Changes to Section 18 (Arbitration) will not apply to any dispute that we already had actual notice of before the change was posted.
3. Your Account
3.1 You must give accurate, current, and complete information and keep it updated.
3.2 You are responsible for keeping your login details secret and for all activity under your account, whether or not you authorized it.
3.3 Tell us right away at hello@yumacranerental.com if you suspect unauthorized use. We are not liable for any loss caused by someone else using your account.
4. Our Rights to Refuse, Change, Suspend, or Terminate
4.1 We may, at any time and for any lawful reason or no reason, with or without notice:
- refuse service to anyone;
- change, pause, limit, or discontinue any part of the Services, features, or pricing;
- edit, reject, hide, or remove any content, listing, ad, or message;
- suspend or terminate any account or access.
4.2 We are not liable to you or anyone else for any of these actions.
4.3 Sections that by their nature should continue after termination will continue, including Sections 6 and 8 through 22.
5. Payments
5.1 You agree to pay all fees shown at the time of purchase, plus applicable taxes.
5.2 You authorize us and our payment processors to charge your payment method for all amounts due.
5.3 Prices may change at any time. Changes do not affect orders already paid for, except as stated in a Subscription module.
5.4 You agree not to file a chargeback or payment dispute for any charge that complies with these Terms. If you do, we may suspend or terminate your account, and you agree to repay the amount reversed plus any processor fees, to the extent permitted by law.
6. All Sales Final — No Refunds
6.1 ALL SALES ARE FINAL. ALL FEES ARE NON-REFUNDABLE, including (without limit) for:
- partial use, non-use, or unused time;
- downgrades or cancellation;
- dissatisfaction with results, leads, traffic, rankings, sales, or outcomes;
- suspension, removal, or rejection of any listing, ad, content, or account for cause, including violation of these Terms or any law;
- changes to or discontinuation of features.
6.2 Exception: This section does not apply where a specific law requires a refund or cancellation right that cannot be waived. In that case you get only the minimum refund the law requires.
6.3 We may, in our sole discretion, give a refund or credit in a particular case. Doing so does not create any obligation to do so again.
6.4 If we terminate the Services entirely without cause for reasons other than those in Section 21 (Force Majeure), we may, in our discretion, give a pro-rated credit or refund for prepaid, unused time. This is your only remedy.
7. Acceptable Use
You agree not to:
- break any law or regulation, or help anyone else do so;
- post anything false, misleading, defamatory, obscene, hateful, harassing, or infringing;
- send spam or any message without the legally required consent;
- impersonate anyone or misrepresent your affiliation;
- upload malware, or probe, scan, overload, hack, or disrupt the Services;
- scrape, crawl, copy, or harvest data from the Services without our written permission;
- reverse engineer, resell, sublicense, or frame the Services;
- use the Services to build a competing product;
- get around any security, access limit, or payment.
8. Your Content and Your Responsibility
8.1 "Your Content" means anything you or anyone using your account submits, posts, uploads, sends, or publishes through the Services, including listings, ads, profiles, reviews, images, messages, emails, texts, contact lists, and data.
8.2 You are solely responsible for Your Content and for what happens because of it. This includes making sure it is accurate, lawful, and not infringing, and that it complies with all advertising, consumer protection, privacy, anti-spam, licensing, and industry rules that apply to you.
8.3 Consents are your responsibility. If you use the Services to contact anyone by email, phone, text (SMS/MMS), or automated means, you alone are responsible for getting and keeping proof of all legally required consents, including under the Telephone Consumer Protection Act (TCPA), CAN-SPAM, state telemarketing and "mini-TCPA" laws, and Do-Not-Call rules, and for honoring every opt-out. We are not the sender of your messages.
8.4 You promise that you own or have all rights needed for Your Content, and that Your Content and your use of it do not violate any law or anyone's rights.
8.5 License to us. You give us a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, copy, display, adapt, format, translate, distribute, and promote Your Content as needed to run, improve, and market the Services. This license ends when Your Content is removed, except for copies in backups, logs, or already distributed, and except where we must keep it by law.
8.6 We have no duty to review or monitor Your Content, but we may do so and may remove anything at any time. We are not responsible for any content posted by users or third parties. We act as a provider of an interactive computer service under 47 U.S.C. § 230.
8.7 Feedback and suggestions you give us may be used by us freely without any obligation to you.
9. No Professional Advice; AI-Generated Content
9.1 The Services provide general information only. Nothing in the Services is legal, medical, health, financial, investment, tax, accounting, insurance, real estate, or other professional advice, and no professional–client relationship is created. Continuing education materials are for learning only and do not guarantee licensure, credits, certification, or approval by any board or regulator unless we expressly state otherwise in writing for a specific course.
9.2 AI tools. Some Services use artificial intelligence. AI-generated content may be inaccurate, incomplete, outdated, biased, or offensive, and may resemble other content. You must review and verify any AI output before you rely on it or publish it. You are solely responsible for how you use AI output.
9.3 Always consult a qualified, licensed professional before making decisions based on anything in the Services.
9.4 We do not guarantee any results, including income, leads, sales, rankings, traffic, or exam outcomes.
10. Disclaimer of Warranties
10.1 THE SERVICES AND ALL CONTENT, PRODUCTS, AND AI OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND.
10.2 TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, RELIABILITY, QUIET ENJOYMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
10.3 WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, AVAILABLE AT ANY TIME (UPTIME), TIMELY, SECURE, ERROR-FREE, OR FREE OF VIRUSES; THAT DEFECTS WILL BE FIXED; THAT DATA WILL NOT BE LOST; OR THAT ANY RESULTS WILL BE ACHIEVED.
10.4 You use the Services at your own risk. Some places do not allow certain warranty disclaimers, so some of the above may not apply to you, but only to the extent required by that law.
11. Limitation of Liability
11.1 NO INDIRECT DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE COMPANY, ITS OWNER, MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, OR SUPPLIERS (THE "COMPANY PARTIES") BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL, INDIRECT, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, DATA, OR OPPORTUNITY, OR COST OF SUBSTITUTE SERVICES, HOWEVER CAUSED, EVEN IF ADVISED OF THE POSSIBILITY.
11.2 CAP. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF ALL COMPANY PARTIES COMBINED, FOR ALL CLAIMS OF ANY KIND RELATING TO THE SERVICES OR THESE TERMS, WILL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE FIRST CLAIM. IF YOU PAID NOTHING (FOR EXAMPLE, A FREE USER), OUR TOTAL LIABILITY IS ZERO ($0). THERE IS NO MINIMUM DOLLAR AMOUNT.
11.3 These limits apply to every legal theory, whether contract, tort (including negligence), strict liability, statute, or otherwise, and even if a remedy fails of its essential purpose.
11.4 These limits are an essential part of the bargain. Our prices would be higher without them.
11.5 Nothing in these Terms limits liability that cannot be limited by law (for example, in some places, for fraud, gross negligence, or willful misconduct). In those cases, our liability is limited to the smallest amount the law allows.
11.6 Owner protection. You agree that the Company is a limited liability company and that you will bring any claim only against the Company, not against its owner, members, managers, or agents personally, to the maximum extent permitted by law.
12. Indemnification (You Protect Us)
12.1 To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless the Company and its owner, members, managers, officers, employees, contractors, agents, licensors, and service providers, and the providers of any software or AI tools we use (together, the "Indemnified Parties"), from and against all claims, demands, lawsuits, investigations, fines, penalties, losses, damages, judgments, settlements, costs, and expenses (including reasonable attorneys' fees and expert fees) arising out of or related to:
- Your Content, ads, listings, messages, and consents;
- your use or misuse of the Services or any AI output;
- your breach of these Terms or any law (including TCPA, CAN-SPAM, privacy, advertising, and licensing laws);
- your violation of anyone's rights, including intellectual property, privacy, or publicity rights;
- your products, services, business, customers, and dealings with other users.
12.2 We may take over the defense of any matter at your expense, and you will cooperate. You may not settle any matter without our prior written consent.
13. Third-Party Services and Links
The Services may include or link to third-party websites, payment processors, platforms, tools, or AI providers. We do not control them and are not responsible for them, their content, their availability, or their privacy practices. Your use of them is at your own risk and subject to their terms.
14. Privacy
Our Privacy Policy at https://yumacranerental.com/privacy explains how we collect and use information and is part of these Terms. By using the Services, you consent to our data practices described there.
15. Our Intellectual Property
15.1 The Services, including all software, text, courses, designs, graphics, logos, and the Yuma Crane Connect™ name and marks, are owned by the Company or its licensors and protected by copyright, trademark, and other laws.
15.2 We give you a limited, personal, revocable, non-exclusive, non-transferable license to use the Services for their intended purpose under these Terms. All other rights are reserved. You may not use our trademarks without our written permission.
16. Copyright Complaints (DMCA)
16.1 We respect intellectual property rights. If you believe content on the Services infringes your copyright, send a written notice to our designated agent with:
- your physical or electronic signature;
- identification of the copyrighted work;
- identification of the infringing material and where it is located on the Services;
- your name, address, phone number, and email;
- a statement that you have a good-faith belief the use is not authorized by the owner, its agent, or the law;
- a statement, under penalty of perjury, that the information is accurate and you are the owner or authorized to act for the owner.
DMCA Agent: Designated Agent, Continuing Education And Training, LLC, 500 Westover Drive, Suite 17707, Sanford, NC 27330. Email: hello@yumacranerental.com.
16.2 If your content was removed, you may send a counter-notice as allowed by 17 U.S.C. § 512(g).
16.3 We will terminate accounts of repeat infringers in appropriate circumstances. Knowingly false claims may lead to liability for damages under 17 U.S.C. § 512(f).
17. Time Limit to Bring Claims
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANY CLAIM OR CAUSE OF ACTION RELATING TO THE SERVICES OR THESE TERMS MUST BE FILED WITHIN ONE (1) YEAR AFTER IT AROSE, OR IT IS PERMANENTLY BARRED.
18. Dispute Resolution: Binding Individual Arbitration
18.1 Informal resolution first. Before starting arbitration or a small-claims case, you must send a written notice describing your claim and the relief you want to: Continuing Education And Training, LLC, Attn: Legal, 500 Westover Drive, Suite 17707, Sanford, NC 27330, and by email to hello@yumacranerental.com. We both agree to try in good faith to resolve it for 60 days.
18.2 Agreement to arbitrate. If not resolved, you and we agree that any dispute, claim, or controversy relating in any way to the Services or these Terms (including whether this arbitration agreement is valid, enforceable, or applies) will be resolved only by final and binding arbitration, not in court.
18.3 Rules and place. Arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules if you are an individual using the Services mainly for personal, family, or household purposes, or its Commercial Arbitration Rules in all other cases. The arbitration will take place in Maricopa County, Arizona, unless the AAA rules require otherwise, and may be held by video, phone, or written submissions where the rules allow. Fees are paid as set by the AAA rules. The Federal Arbitration Act governs this Section 18.
18.4 Small-claims exception. Either party may bring an individual claim in small-claims court in Maricopa County, Arizona (or your county of residence if required by law), as long as the claim stays in that court and on an individual basis.
18.5 Other exceptions. Either party may seek an injunction in court to stop infringement or misuse of intellectual property, or unauthorized access to the Services.
18.6 CLASS-ACTION WAIVER. YOU AND WE MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION OR ARBITRATION. The arbitrator may not combine more than one person's claims and may award relief only to the individual party bringing the claim.
18.7 JURY-TRIAL WAIVER. YOU AND WE EACH WAIVE ANY RIGHT TO A JURY TRIAL for any dispute, whether in arbitration or in court.
18.8 Mass filings. If 25 or more similar arbitration demands are filed by or with the help of the same law firm or group, they will be administered in batches under the AAA's mass-arbitration procedures, and the claimants and we agree to cooperate in good faith on scheduling and fees.
18.9 Opt-out. You may opt out of this arbitration agreement by mailing a signed written notice to the address in 18.1 within 30 days after you first accept these Terms. Opting out does not affect any other part of these Terms.
18.10 Severability of this section. If the class-action waiver is found unenforceable for a claim, that claim (and only that claim) will be decided in court under Section 19, and stayed until any arbitrable claims are resolved. The rest of Section 18 stays in force.
19. Governing Law and Venue
19.1 These Terms are governed by the laws of the State of Arizona and applicable U.S. federal law, without regard to conflict-of-law rules. The UN Convention on Contracts for the International Sale of Goods does not apply.
19.2 For any matter not subject to arbitration, or to compel, confirm, or vacate an arbitration award, exclusive venue is in the state or federal courts located in Maricopa County, Arizona, and you consent to their personal jurisdiction.
19.3 If we must take legal action to collect amounts you owe or enforce these Terms and we win, you will pay our reasonable attorneys' fees and costs, to the extent permitted by law.
20. Communications
You agree that we may send you notices, receipts, and other communications electronically (by email, in-app, or by posting on the Services), and that these satisfy any legal requirement that they be in writing. Marketing emails will include an unsubscribe link and our address: 500 Westover Drive, Suite 17707, Sanford, NC 27330.
21. Force Majeure
We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including acts of God, natural disasters, fire, flood, epidemic, war, terrorism, riots, government action, labor disputes, power or internet outages, cyberattacks, failures of hosting, payment, AI, or other third-party providers, or changes in law or platform policies.
22. General Terms
22.1 Entire agreement. These Terms, the Privacy Policy, and any order forms or policies we post or reference are the entire agreement between you and us about the Services and replace all prior agreements, statements, and understandings.
22.2 Severability. If any part of these Terms is found unenforceable, it will be enforced to the maximum extent allowed and the rest will remain in full force.
22.3 No waiver. Our failure or delay in enforcing any right is not a waiver of it. Any waiver must be in writing and signed by us.
22.4 Assignment. You may not assign or transfer these Terms or your account without our written consent. We may assign or transfer these Terms freely, including in a merger, sale, or reorganization.
22.5 Independent parties. No partnership, joint venture, employment, agency, or fiduciary relationship is created by these Terms.
22.6 No third-party beneficiaries, except the Company Parties and Indemnified Parties, who may enforce Sections 10, 11, and 12.
22.7 Headings are for convenience only. "Including" means "including without limitation."
22.8 Conflict. If a module below conflicts with the main Terms, the module controls for that Service only. If a translation conflicts with the English version, the English version controls.
22.9 Contact: Continuing Education And Training, LLC d/b/a Yuma Crane Connect™, 500 Westover Drive, Suite 17707, Sanford, NC 27330. Email: hello@yumacranerental.com.
Additional Terms
Module A: Subscriptions and Auto-Renewal
A.1 Automatic renewal. Subscriptions renew automatically at the end of each billing period (monthly) at the then-current price, and your payment method will be charged automatically, until you cancel. The price, billing period, and renewal terms are shown before you subscribe and in your confirmation email.
A.2 How to cancel. You can cancel anytime by emailing hello@yumacranerental.com. Cancellation is at least as easy as signing up. Cancel before the renewal date to avoid the next charge. Cancellation takes effect at the end of the current paid period; you keep access until then.
A.3 No refunds. Except where the law requires otherwise, fees already charged are not refunded, including for partial periods (see Section 6).
A.4 Free trials. If you start a free trial, your payment method will be charged automatically when the trial ends unless you cancel before then. We will remind you before the trial converts where required by law.
A.5 Price changes. We will give you notice of any price increase at least 30 days before it takes effect. If you do not cancel before it takes effect, you accept the new price.
A.6 Failed payments. If a payment fails, we may retry the charge, and suspend or downgrade your access until paid.
Module B: Sponsored Ads and Listings
B.1 Labeling. Paid placements, ads, and featured or promoted listings will be clearly labeled "Sponsored" (or a similar label such as "Ad" or "Promoted").
B.2 No effect on editorial. Payment does not buy and does not affect our editorial content, reviews, rankings, ratings, awards, or recommendations, except for the labeled sponsored placement itself.
B.3 Advertiser responsibility. You (the advertiser) are solely responsible for your ads and listings, including that they are truthful, substantiated, and comply with the FTC Act, the FTC Endorsement Guides, licensing rules, fair-housing and anti-discrimination laws, and all other laws.
B.4 Our rights. We may reject, edit, reposition, pause, or remove any ad or listing at any time. No refund is owed if we remove an ad or listing for cause.
B.5 No guarantees. We do not guarantee impressions, clicks, leads, placement, rankings, or results. Any reports or metrics are estimates and are provided as-is.
Module D: Marketplaces and Directories
D.1 We are a venue only. We provide a platform where users and businesses can list, find, and contact each other. We are not a party to any transaction or agreement between users, and we are not a broker, agent, employer, or guarantor of any user.
D.2 No verification or endorsement. Unless we clearly say so, we do not verify, screen, endorse, or guarantee any listing, business, license, credential, review, rating, product, or service. Any "verified" badge means only what we describe for that badge.
D.3 Deal at your own risk. You are solely responsible for checking out anyone you deal with and for your transactions. You release the Company Parties from all claims, losses, and damages arising from disputes between users, to the maximum extent permitted by law. California residents: you waive California Civil Code § 1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."
D.4 Listings and reviews. Listing owners are responsible for keeping listings accurate and lawful. Reviews must reflect genuine experiences; fake, paid, or incentivized reviews without disclosure are prohibited. We may remove listings or reviews at our discretion and may display listings in any order, including sponsored placements labeled under Module B.
D.5 Public information. Directories may include business information from public sources. Businesses may request correction or removal at hello@yumacranerental.com.
End of Terms.
